Judicial Activism again to Govt of Kerala.

I think the judiciary places itself on top of other democratic institutions in the country. To come straight to the point that the Honourable Supreme Court has observed that Government of Kerala supercedes  the verdict of the High court of Kerala. Infact the High Court of Kerala had involved in unwanted issues regarding conduct of Public meetings on the roads of Kerala. It is to be noted that there has been an unanimity in the Legislature which frames the law in framing a policy regarding the restrictions of Public Meetings on Roads.

I shall be so humble to point out to the so called Judges that you are never above the common man. The common man fights for his rights and all through democratic means. This may take the form of Political Organisations. We have elected our representatives to frame a law for the common man's right. When a very few minority who pose themselves as so called human rights activists and all post some public litigation, Its not good for the Courts to take a decision against a ruling and democratic institution like the legislature. The observation made by the supreme court justice's in any way doesn't cope up with the reality. I shall remind them that India has been a land of a massive movement during the regime of the British. There has been rallies and protests in those times even against the government. These protest were not taken in the houses rather it was brought to the notice of the common man through rallies in roads.

The country may have developed but still the rights of the people are yet to be received. There can be emergencies which can happen and in no case any political party will block such an emergency vehicle or persons. They will provide way for any emergency issues. Its these political parties which have paved way in one form or the other for freedom of our great nation. Now the judiciary is trying to prove that the legislature who are the elected representatives of the people are against the people which is quite unfortunate. If the judiciary can observe something which is against the legislature then as a common  man I have the right to think so.

How I view this issue is not only as judicial activism. This is a strong message against the political organisations which actively involve in the fights for the rights of the common man. Mass Protests cannot be stopped by this kind of Judicial Vandalism. As a common man he has the right to protest or to march against or for the country. In such cases, if any observations comes from the highest judicial body, then its unfortunate.

Let me conclude to my fellow youth and those against the protest and rallies. What ever you have received now after freedom to India in 1947, It is because of the struggle of these political Institutions and Political Parties which have promised and provided all amenities. No Judiciary have involved and tried to reduce the price of the Items distributed through Public Distribution System. No Judiciary has involved in providing the Compulsory Education System. No Judiciary has involved in providing amenities such as shelter and food.  You have to go by law but the right to protest and to hold meetings for or against should be upheld. Otherwise we are near to the hands of imperialist colonialism. You will regret then
